REVIEW OF EXISTING EVALUATION DATA

  FEDERAL AND STATE REQUIREMENTS
A review of existing evaluation data (REED) is required as part of an initial evaluation, if appropriate, and as part of any reevaluation. Citations:
The REED must be conducted by the admission, review, and dismissal (ARD) committee members and other qualified professionals, as appropriate. Citations:
In the case of the child with a visual impairment, the scope of any reevaluation must be determined by a multidisciplinary team that includes an appropriately certified orientation and mobility specialist.
The ARD committee may conduct the REED without a meeting. Citations:
In conducting the REED, the ARD committee must review: Citations:
  • Evaluation and information provided by the parents of the child;

  • Current classroom-based, local, or state assessments, and classroom-based observations; and
Citations:
  • Observations by teachers and related services providers.

On the basis of the REED, and input from the child's parents, the ARD committee must identify what additional data, if any, are needed to determine: Citations:
  • Whether the child is a child with a disability, and the educational needs of the child, or, in the case of a reevaluation of the child, whether the child continues to have such a disability and the educational needs of the child;

  • Whether the child needs special education and related services, or, in the case of a reevaluation of the child, whether the child continues to need special education and related services;

  • The present levels of academic achievement and related developmental needs of the child; and
Citations:
  • Whether any additions or modifications to the special education and related services are needed to enable the child to meet the measurable annual goals set out in the individualized education program of the child and to participate, as appropriate, in the general education curriculum.

REQUIREMENTS IF ADDITIONAL DATA ARE NEEDED
If the ARD committee identifies additional data that are needed, the local educational agency (LEA) must administer such assessments and other evaluation measures as may be needed to produce the data according to the EVALUATION PROCEDURES framework. Citations:
 
REQUIREMENTS IF ADDITIONAL DATA ARE NOT NEEDED
If the ARD committee determines that no additional data are needed to determine whether the child continues to be a child with a disability and to determine the child's educational needs, the LEA must notify the child's parents of: Citations:
  • That determination and the reasons for the determination; and
Citations:
  • The right of the parents to request an assessment to determine whether the child continues to be a child with a disability and to determine the child's educational needs.

The LEA is not required to conduct such an assessment unless requested to do so by the child's parents. Citations:
