TERMINACIÓN DE ELEGIBILIDAD POR EDAD O CIERTOS REQUISITOS DE GRADUACIÓN

Cumplir la elegibilidad máxima de edad termina la elegibilidad de un niño para recibir servicios. Un niño elegible que recibe servicios de educación especial que tiene 21 años de edad en septiembre 1 de un año escolar será elegible para servicios hasta el final de ese año escolar, o hasta la graduación con un diploma, cualquiera que sea primero.  

Citas:

Un niño que recibe servicios de educación especial puede graduarse y ser otorgado un diploma que termina la elegibilidad del niño para servicios de educación especial bajo la Ley de Educación para Individuos con Discapacidades y un derecho a los beneficios del Programa de Fundación de Escuela cuando:

  • Un niño que recibe servicios de educación especial:

  • Demuestra desempeño satisfactorio establecido para estudiantes en educación general en los instrumentos de evaluación requeridos de fin de curso. 
Citas:
  • Completa satisfactoriamente los requisitos de crédito para graduación bajo el Programa de Fundación de Preparatoria aplicable a estudiantes en educación general; y 
Citas:
  • Demuestra desempeño satisfactorio establecido para estudiantes en educación general en los instrumentos de evaluación requeridos de fin de curso. 
Citas:

Un niño que está clasificado en el grado 11 ò 12 que ha tomado cada una de las evaluaciones requeridas del estado, pero falló lograr desempeño satisfactorio en no más de dos de las evaluaciones es eligible para recibir un diploma si el niño llena los requisitos restantes para un diploma.

Citas:

Terminación de elegibilidad requiere cumplir con la estructura de RESUMEN DE DESEMPEŇO; y

Constituye un cambio de colocación y requiere cumplir con la estructura de AVISO PREVIO ESCRITO.

 

CONTINUING ELIGIBILITY NOTWITHSTANDING GRADUATION

A child who receives special education services may graduate, be awarded a diploma, and resume services after graduation, as long as the child meets the age eligibility requirements, and:

  • Demonstrates mastery of the required state standards (or district standards if greater);

  • Satisfactorily completes credit requirements for graduation under the Foundation High School Program applicable to students in general education; and
Citas:
  • The child’s admission, review, and dismissal (ARD) committee determines that satisfactory performance on the required end-of-course assessment instruments is not required for graduation.

A child who receives special education services may also graduate, be awarded a diploma, and resume services after graduation, as long as the child meets the age eligibility requirements, and:

Citas:
  • Satisfactorily completes credit requirements for graduation under the Foundation High School Program one or more of which contains modified curriculum that is aligned to the standards applicable to students in general education; 

Citas:
  • Demonstrates mastery of the required state standards (or district standards if greater) in accordance with modified content and curriculum expectations established in the child's individualized education program (IEP); 

Citas:
  • Demonstrates satisfactory performance on the required end-of-course assessment instruments, unless the child's ARD committee has determined that satisfactory performance on the required end-of-course assessment instruments is not required for graduation;

  • The child also successfully completes the child's IEP; and
Citas:
  • Meets one of the following conditions:

  • Consistent with the IEP, the child has obtained full-time employment, based on the child's abilities and local employment opportunities, in addition to mastering sufficient self-help skills to enable the child to maintain the employment without direct and ongoing educational support of the local school district;

Citas:
  • Consistent with the IEP, the child has demonstrated mastery of specific employability skills and self-help skills that do not require direct ongoing educational support of the local school district; or

Citas:
  • The child has access to services or other supports that are not within the legal responsibility of public education, including employment or postsecondary education established through transition planning.

Employability and self-help skills are those skills directly related to the preparation of children for employment, including general skills necessary to obtain or retain employment.

Modified curriculum and modified content refer to any reduction of the amount or complexity of the required Texas Essential Knowledge and Skills.

Substitutions that are specifically authorized in statute or rule must not be considered modified curriculum or modified content.

For the child who meets graduation requirements but continues enrollment in public school to receive special education services aligned to their transition plan:

  • These children are entitled to participate in commencement ceremonies and receive a certificate of attendance after completing four years of high school.
Citas:
  • The ARD committee must determine needed special education services upon the request of the adult student or parent;
Citas:
  • Upon exit from the public school system, the local educational agency (LEA) will comply with the SUMMARY OF PERFORMANCE framework; and
Citas:
  • Upon exit from public school, the adult student is entitled to an evaluation, and the LEA must act in accordance with the EVALUATION PROCEDURES framework.

CERTIFICATES OF ATTENDANCE AND PARTICIPATION IN GRADUATION CEREMONIES

The LEA must issue a certificate of attendance to the child who has completed four years of high school but has not completed the IEP.

The LEA must allow the child who receives a certificate of attendance to participate in a graduation ceremony with students receiving high school diplomas.

The child may participate in only one graduation ceremony to receive a certificate of attendance.

The child who receives a certificate of attendance is not prevented from receiving a diploma if the child completes the IEP.

SUBSTITUTIONS UNDER THE FOUNDATION HIGH SCHOOL PROGRAM

A child, who due to a disability, is unable to complete two credits in the same language in a language-other-than-English (LOTE), may substitute a combination of two credits from English language arts, mathematics, science, or social studies or two credits in career and technical education, technology applications, or other academic electives for the LOTE credit requirements if the ARD committee determines that the child is unable to complete the LOTE credit requirements.

A child who is unable to participate in physical activity due to a disability or illness may substitute one credit in English language arts, mathematics, science, social studies, a locally-designed course that meets the state criteria for substitution under state law, or one academic credit elective for the physical education (PE) credit requirement if the ARD committee determines that the child is unable to participate in physical activity.

A credit allowed to be substituted for LOTE or PE credit may not be used to satisfy any other graduation credit requirement.

DISTINGUISHED LEVEL OF ACHEIVEMENT OR ENDORSEMENT

A child receiving special education services may earn the distinguished level of achievement or an endorsement by:

  • Satisfactorily completing, with or without modification of the curriculum:
Citas:
    • The curriculum requirements identified by the State Board of Education (SBOE); and
Citas:
    • For the distinguished level of achievement, the additional curriculum requirements; and 
Citas:
    • For an endorsement, the additional curriculum requirements prescribed by the SBOE; and
Citas:
  • Satisfactorily completes all curriculum requirements for the distinguished level of achievement or that endorsement adopted by the SBOE:
Citas:
    • Without modification of the curriculum for those courses; or
Citas:
    • With modification of the curriculum for those courses, provided that the curriculum as modified, is sufficiently rigorous as determined by the child's ARD committee and documented in the child’s IEP.

  • The ARD committee of a child in a special education program will determine whether the child is required to achieve satisfactory performance on an end-of-course assessment instrument to earn the distinguished level of achievement or an endorsement on the child's transcript.
