ADMINISTRATION OF PROGRAM INFORMATION

  FEDERAL AND STATE REQUIREMENTS

The local educational agency (LEA) must comply with the RECORDS frameworks.

 

INFORMATION FOR THE TEXAS EDUCATION AGENCY (TEA)

The LEA must provide the TEA with information relating to the performance of children with disabilities participating in programs carried out under the Individuals with Disabilities Education Act (IDEA) in order for the TEA to carry out its duties. Citations:
The TEA does not have a performance indicator in any agency monitoring system, including the performance-based monitoring analysis system, that solely measures an LEA's aggregated number or percentage of enrolled children who receive special education services.  Citations:
 
INFORMATION REGARDING DISPROPORTIONALITY
The LEA must comply with the CHILD FIND frameworks.
The LEA must comply with the EVALUATION frameworks.
The LEA must comply with the ADMISSION, REVIEW, AND DISMISSAL COMMITTEE frameworks.
The TEA provides for the collection and examination of data through the Public Education Information Management System (PEIMS) to determine if significant disproportionality based on race and ethnicity is occurring in the state and the LEAs of the state with respect to: Citations:
  • The identification of children as children with disabilities including the identification of children as children with particular impairments;

  • The placement of children with disabilities in particular educational settings of such children; and
Citations:
  • The incidence, duration, and type of disciplinary removals from placement including suspensions and expulsions.

In the case of a determination of significant disproportionality with respect to the identification of children as children with disabilities or the placement in particular educational settings, including disciplinary removals of such children, the state requires the LEA to publicly report on the revision of policies, practices, and procedures consistent with the requirements of the Family Educational Rights and Privacy Act. INFORMATION REGARDING THE PROVISION OF A FREE APPROPRIATE PUBLIC EDUCATION (FAPE)
The LEA must comply with the ADMISSION, REVIEW, AND DISMISSAL COMMITTEE frameworks.
The LEA must provide data each year through PEIMS to the TEA who, in turn, reports to the secretary of education and the public the number and percentage of children with disabilities: Citations:
  • By race, ethnicity, limited English proficiency status, gender, and disability category, who are in the following category:

INFORMATION REGARDING LEAST RESTRICTIVE ENVIRONMENT
The LEA must comply with the ADMISSION, REVIEW, AND DISMISSAL COMMITTEE frameworks which includes the LEAST RESTRICTIVE ENVIRONMENT framework.
The LEA must provide data each year through PEIMS to the TEA who, in turn, reports to the secretary of education and the public the number and percentage of children with disabilities: Citations:
  • By race, ethnicity, limited English proficiency status, gender, and disability category, who are in each of the following separate categories:

    • Participating in regular education; and
Citations:
    • In separate classes, separate schools or facilities, or public or private residential facilities.

INFORMATION REGARDING TERMINATION OF SERVICES
The LEA must comply with the EVALUATION frameworks.
The LEA must comply with the ADMISSION, REVIEW, AND DISMISSAL COMMITTEE frameworks which includes the DETERMINATION OF ELIGIBILITY and the GRADUATION frameworks.
The LEA must provide data each year through PEIMS to the TEA who, in turn, reports to the secretary of education and the public the number and percentage of children with disabilities: Citations:
  • By race, ethnicity, limited English proficiency status, gender, and disability category, who are in the following category:

    • For each year of age from age 14-21, stopped receiving special education and related services because of program completion including graduation with a regular secondary school diploma, or other reasons, and the reasons why those children stopped receiving special education and related services.

INFORMATION REGARDING CHILDREN PARENTALLY-PLACED IN PRIVATE SCHOOLS
The LEA must comply with the CHILDREN IN PRIVATE SCHOOLS framework.
The LEA must maintain in its records and provide to the TEA the number of children parentally-placed in private schools who were evaluated, who were determined to be children with disabilities, and who were served. Citations:
 

INFORMATION REGARDING PARTICIPATION IN STATE OR DISTRICTWIDE ASSESSMENTS

The LEA must comply with the ADMISSION, REVIEW, AND DISMISSAL COMMITTEE frameworks which includes the STATE AND DISTRICTWIDE ASSESSMENTS framework.
The TEA, or in the case of a districtwide assessment the LEA, will make available to the public and report to the public with the same frequency and in the same detail as it reports on the assessment of nondisabled children, the following: Citations:
  • The number of children with disabilities participating in regular assessments, and the number of those children who were provided accommodations that did not result in an invalid score in order to participate in those assessments;

  • The number of children with disabilities participating in alternate assessments aligned to the state's content and achievement standards in school years prior to 2017-2018;

  • The number of children with disabilities participating in alternate assessments based on modified academic achievement standards prior to 2016-2017;

  • The number of children with disabilities participating in alternate assessments aligned to alternate achievement standards; and
Citations:
  • The performance of children with disabilities on regular assessments, modified assessments prior to 2016-2017, and on alternate assessments prior to 2017-2018, if statistically reliable information does not reveal personally identifiable information about an individual child, compared with the achievement of all children, including children with disabilities, on those assessments.

INFORMATION REGARDING DISCIPLINE
The LEA must comply with the DISCIPLINE frameworks.
The LEA must comply with the RESTRAINT AND TIME-OUT framework.
The LEA must provide data each year through PEIMS to the TEA who, in turn, reports to the secretary of education and the public the number and percentage of children with disabilities: Citations:
  • By race, ethnicity, limited English proficiency status, gender, and disability category, who are in each of the following separate categories:

    • Removed to an interim alternative educational setting (IAES);
Citations:
    • The acts or items causing removals to an IAES;
Citations:
    • The number and percentage of children with disabilities who are subject to long-term suspensions or expulsions; and
Citations:
    • The incidence and duration of disciplinary actions including suspensions of one day or more; and
Citations:
    • The number and percentage of children with disabilities who are removed to alternative educational settings or expelled compared to children without disabilities who are removed to alternative educational settings or expelled.

The state may require that the LEA include in the records of the child with a disability a statement of any current or previous disciplinary action that has been taken against the child and transmit such statement to the same extent that such disciplinary information is included in, and transmitted with, the records of nondisabled children: Citations:
  • The statement may include a description of any behavior engaged in by the child that required disciplinary action, a description of the disciplinary action taken, and any other information that is relevant to the safety of the child and other individuals involved with the child; and

  • If the state adopts such a policy, and the child transfers from one school to another, the transmission of any of the child's records must include both the child's current individualized education program and any such statement of current or previous disciplinary action that has been taken against the child.

INFORMATION REGARDING CHILDREN WHO ARE MIGRATORY
The LEA must cooperate in the secretary's efforts under the Elementary and Secondary Education Act to ensure the linkage of records pertaining to children with disabilities who are migratory for the purpose of electronically exchanging, among the states, health and educational information regarding such children. INFORMATION ON DIRECT SERVICES BY THE TEA

The TEA will use the payments that would otherwise have been available to the LEA to provide special education and related services directly to children with disabilities residing in the area served by that LEA, if the TEA determines that the LEA has not provided the information needed to establish eligibility under IDEA.
